Cyber Day–Cybersecurity and Proposed Privacy Reforms

September saw the first steps to long-awaited privacy law reform introduced into Parliament as 'Tranche 1' of the privacy reforms. These and ongoing cyber security developments underscore the need to keep your organisation's privacy compliance and cyber resilience strategies up to date.

Session 1: Privacy Regulatory Reform – Ensuring Organisational Readiness | 10:45 AM – 11:15 AM

This session will provide attendees with an overview of the 'Tranche 1' reform proposals and likely next stage of reforms, insight into how to prepare your organisation for future privacy changes, what guidelines you need to be prepared for and what the transition period will look like.

Session 2: Employment Laws and Expected Privacy Reforms | 11:15 AM – 11:45 AM

Protecting employee and employer data is vital, during this session we will look at:

  • The potential removal and narrowing of employee record exemptions;
  • The role of consent when collecting sensitive information;
  • What to do when an employee brings direct action; and
  • The protection of employee data, including new policies and how best to approach them.

Session 3: Marketing and Consents in an Increasingly Digital World | 11:45 AM – 12:15 PM

This session will take a look at what the key proposed Privacy Act reforms around marketing and consents are (largely not addressed in Tranche 1), when we might expect to see these reforms introduced, and how your organisation can best plan to obtain and ensure ongoing privacy consents for marketing activities.

The session will also look at the potential impacts of future reforms on tracking abilities within the market when retargeting consumers online.

Session 4: Breach Response / Role of a Good Cyber Security Framework – Panel Discussion | 12:45 PM – 1:45 PM

This panel session will focus on:

  • The role of a chief information security officer (CISO);
  • How to think about, approach, and implement a strong cyber security framework within your organisation;
  • The role of legal counsel;
  • The proposed changes to legislation regarding breach responses and the requirements to businesses;
  • Insights from the front line – data breach response, how we've seen this undertaken most effectively, and services for mitigating damage and restoring trust in the organisation;
  • Which third parties you should have on hand when mitigating and responding to breaches; and
  • Proposed new requirements under a Cyber Security Act.

Session 5: Security of Critical Infrastructure Act 2018 (SOCI) | 1:45 PM – 2:15 PM

This session will look at the key obligations and timeframes for the SOCI regime and how a risk management professional can assist your organisation with compliance.

Session 6: Litigation – Statutory Torts and Direct Rights of Action | 2:30 PM – 3:30 PM

This session will provide attendees insight into what we can expect from class actions and direct actions, along with what to expect from statutory torts.

Session 7: Artificial Intelligence (AI) and Human Rights | 3:30 PM – 4:00 PM

This session will look at:

  • Deploying AI tools:
    • Selecting the right AI tools;
    • Assessing the risks and opportunities; and
    • Training and supervision.
  • Privacy, data governance and security:
    • Privacy implications of using personal information for training AI models;
    • IP in training datasets and retaining any proprietary value; and
    • Data governance when contracting with service providers.
  • Regulatory responses – Australia and comparative international jurisdictions.
