The panelists, including an accomplished legal scholar and three leading practitioners–each with significant prior governmental leadership experience within the DOJ as well as the former White House Counsel to President Biden–will explore:

  • What the opinions said and didn’t say in Loper Bright, Corner Post, and Jarkesy;
  • How these rulings may interact with the Major Questions Doctrine, prior construction, and other canons;
  • What these decisions could mean for agency authority, adjudication, and enforcement;
  • How older rules might become more vulnerable to new challenges;
  • Where congressional action might fit into the puzzle;
  • What potential litigants should consider and plan for in response to these changes.

Questions will be submitted live to the faculty and all registrants will receive downloadable course materials to accompany the program.
