Kimberli A. Diggs

Kimberli Diggs is an associate in the firm’s Labor, Employment, and Workplace Safety practice. She partners with management on a broad range of employment matters including internal investigations, claims of workplace misconduct, accommodation and leave requests, and considerations surrounding reductions-in-force and reorganizations. Kimberli regularly counsels management regarding compliance strategies and employment practices across the employment lifecycle including: employment agreements, hire and onboarding, employee discipline and termination, harassment and discrimination prevention, and wage and hour compliance. As an advisor and counselor, Kimberli prioritizes customized compliance strategies that proactively protect clients’ workplace culture, brand, and reputation.

Kimberli has extensive litigation experience and regularly defends single-plaintiff, class, collective action, and representative Private Attorneys General Act (PAGA) litigation. She has represented employers in state and federal court, mediation, and arbitration. As a litigator, Kimberli works to understand competing interests and relevant risk appetites to develop effective litigation strategies.

Prior to joining the firm, Kimberli was an associate at an international, full-service law firm. In this role, Kimberli served as lead associate on high-stakes single-plaintiff, class, collective, and representative suits, including complex wage and hour class and PAGA representative actions. She successfully represented employers before administrative agencies including the California Civil Rights Department (formerly known as the Department of Fair Employment and Housing), Equal Employment Opportunity Commission, and California Division of Labor Standards Enforcement. She also provided employers with day-to-day advice and counsel.

During law school, Kimberli served as a judicial extern for the Honorable Jane Magnus-Stinson of the US District Court for the Southern District of Indiana.
