Rachelle Downie

Rachelle is an experienced intellectual property litigator with a scientific background. She acts for clients in complex, high-value intellectual property litigation and has particular expertise in litigating multi-jurisdictional pharmaceutical patent disputes. Rachelle assists clients across a range of industries including health life sciences, technology, FMCG, mining and resources, automotive and fashion. Rachelle advises on all areas of intellectual property including trade marks, copyright, confidential information and consumer law matters.  Rachelle is also a registered Trade Mark Attorney.

Rachelle is passionate about patents and is known for working collaboratively with clients to develop strategic patent enforcement and defensive strategies. She has a deep knowledge of the pharmaceutical and the life science sectors and is a trusted advisor for numerous multi-national pharmaceutical and biotechnology clients. Rachelle regularly represents clients in patent infringement and revocation proceedings, including urgent interlocutory applications, where she has acted in and advised on patent disputes concerning small molecule therapeutics, biologic medicines, protein therapeutics, biotechnology inventions, genetics, mining equipment, automotive, IT and consumer goods. Rachelle’s expertise in the health life sciences sector is strengthened by her pharmacy degree and previous practice as a pharmacist.

Throughout her career, Rachelle has developed a strong aptitude for working with clients in technology-focused sectors. She regularly provides strategic pre-litigation and freedom-to-operate advice to new market entrants and has a particular interest in new and emerging technologies, biotechnology, renewables and ESG. Rachelle has a reputation for being technically excellent, responsive and commercial, and is dedicated to achieving the best outcomes for her clients.

Prior to joining K&L Gates, Rachelle was a special counsel in the intellectual property group at Australia’s leading independent law firm in Melbourne.
