Professional Liability

Our Professional Liability team delivers practical, commercially focused advice, born out of many years of experience gained working for clients in the professional services sector. Our Professional Liability lawyers have successfully acted on a wide variety of claims asserted against professionals such as lawyers, accountants, financial advisers, pension consultants, architects, engineers, and others. Our clients range from some of the largest, most prestigious international firms and professional service providers to regional and smaller firms and companies, as well as individuals.

Our global practice regularly represents parties in US, Australian and English courts in actions for malpractice or professional negligence, breach of fiduciary duty, and fraud or malicious prosecution. Additionally, we advise firms and individuals on law enforcement and regulatory investigations involving the US Securities and Exchange Commission, the Australian Securities and Investments Commission and Prudential Regulation Authority, the UK Financial Conduct Authority and Financial Reporting Council, and US state and local grievance and disciplinary committees.

Our firm also handles disputes among professionals arising out of firm breakups, and the claims of breach of fiduciary duty, improper client solicitation, and other alleged ethical violations that typically arise in these situations. Recognizing that our clients are themselves often sophisticated in the subject matter of a particular claim, or in litigation generally, we work closely with them in ongoing tactical and strategic decision making.

We also work closely with our professional service clients to maximize insurance coverage, where available, and to respond to any appropriate requirements imposed by insurers, particularly where paying defense costs. Our team can also advise on any potential coverage issues and represent professionals in disputes with their insurers, seeking to resolve such disputes, where possible, without recourse to litigation or arbitration.
