Joshua C. Carpenter

Joshua Carpenter is a partner and provides multi-faceted service to global and local clients in a variety of industries, including the manufacturing, construction, real estate, transportation, and hospitality sectors.  

Josh is a member of the firm's Commercial Disputes practice group with a wealth of experience litigating and arbitrating complex and high-stakes cases in both state and federal courts across the United States in a number of practice areas, with a particular emphasis on product liability defense, and construction and real estate disputes involving breach of contract and professional negligence claims. Josh has first-chair trial experience, has tried a case to verdict in federal court, has successfully argued state and federal appeals, and successfully arbitrated American Arbitration Association matters to final (and favorable) award. Josh also assists and advises his clients in complying with applicable regulations, structuring minor transactions, and drafting warnings and tutorials to minimize risk.  

In his product liability practice, Josh has successfully represented dozens of manufacturers and distributors across a range of industries defending strict product liability, design defect, wrongful death, negligence, fraud, warning, and breach of warranty/contract claims. These claims include actions in state and federal courts around the country, and class action and multi-district litigation. In particular, Josh has assisted large multinational manufacturers in the pharmaceutical, recreational marine, electronics, and consumer logistics sectors.  

In his construction and real estate practice, Josh has represented clients ranging from the defense of Fortune 500 engineering and design-build firms in breach of contract and professional negligence claims in multi-million dollar public construction projects, to pursing claims for breach of contract, negligence, and fraud on behalf of local developers involved in property acquisition and land use disputes.  

Josh prides himself on using creative negotiation and procedural tools to help his clients (1) avoid disputes before they ever arise, (2) when they do inevitably arise, quickly and efficiently resolving disputes before formal litigation is filed, and then (3) aggressively litigating to a favorable result when litigation is unavoidable. Regardless of the size of the client or case, Josh implements his particular set of skills to deliver optimal results for his client in the most efficient manner.

Josh has been recognized by Best Lawyers: Ones to Watch® for several years running, and recently received an award from the Florida Daily Business Review as “Most Effective Counsel” for his pro bono representation of a Florida prisoner in a religious civil rights case.

Prior to joining the firm, Josh served as a law clerk for Chief Judge Leslie B. Rothenberg at Florida’s Third District Court of Appeal. After clerking, he spent several years as a litigation associate for a full-service global law firm where he focused primarily on complex multi-district litigation in the pharmaceutical and medical device field. Josh also has significant experience litigating health care disputes, fraud-based claims, bankruptcy issues, arbitrations, and in all aspects of the appellate process.
