Prepared a Coexistence and Settlement Agreement between a client manufacturing dental and oral instruments, handpieces, and lasers and a dental and medical care provider to settle and extinguish a Cancellation Proceeding and enable the federal trademarks to harmoniously coexist.
Drafted, prepared, and filed a trademark takedown report with Facebook and LinkedIn pertaining to trademark infringement of a foundation's longstanding marks resulting in successful removal of infringing party's social media accounts in entirety.
Drafted, prepared, and filed a trademark takedown report with Instagram pertaining to trademark infringement of a foundation's longstanding marks resulting in successful takedown of infringing party's Instagram account in entirety.
Assisted with an Opposition based upon likelihood of confusion, failure to use the mark, and fraud filed against a pending US trademark application for a stylized mark on behalf of a consumer product company, resulting in successful Notice of Default.
Assisted with Petitions to Cancel based upon non-use against the federal trademark registrations for LULUQUEEN and Design and LULU MOON resulting in successful settlement and deletion of relevant registered goods to enable approval of LULU COMPLETE CLEAN, U.S. App. No. 97/121,986, and LULU QUICK CLEAN, U.S. App. No. 97/121,992.

Prosecution

Drafted a successful Office Action Response overcoming initial Section 2(d) likelihood of confusion refusal on behalf of a technology client in the robotics engineering space.
Prepared Coexistence and Settlement Agreements between a consumer product client and a third party that restricted its identification as settlement to our Petitions to Cancel its registration(s) to enable the federal trademarks to harmoniously coexist.
Prepared a Coexistence Agreement on behalf of an early education public advocacy client and third party in the child development education field with a pending US application that amended and restricted the third party’s identification, use, and registration rights to protect and preserve client’s existing trademark registrations and future trademark rights and enable federal and common law marks to harmoniously coexist.
Assisted with a Letter of Protest based on likelihood of confusion filed against a pending US trademark application on behalf of a consumer product company that was successfully accepted by the USPTO as substantively influential.
Prepared a successful Office Action Response overcoming an initial Section 2(d) likelihood of confusion refusal and obtaining approval of a US trademark application for a mark and client in the sports industry.
Prepared a successful Office Action Response overcoming an initial Section 2(d) likelihood of confusion refusal and obtaining approval for a US trademark application for a mark in the health and life science field.
