Mr. Payne is a commercial litigator with extensive experience in all Victorian jurisdictions and in the Federal Court of Australia. He also acts in disputes in New South Wales, Queensland and South Australia.

Mr. Payne's focus in recent years has been in the running of complex litigation and advising clients in a range of competition law and related areas including restraint of trade, restrictive trade practices, franchise disputes, misleading and deceptive conduct, unconscionable conduct, manufacturer’s product liability, consumer safety and the preparation and implementation of trade practices compliance, training and awareness programs. He also advises clients on Australian Competition and Consumer Commission investigations and enforcement proceedings.

In addition to his experience in competition law matters, Mr. Payne also acts for a range of large to medium corporate and private clients across a diverse range of areas including contract disputes, confidential information claims, property disputes and retail and commercial lease litigation.

Mr. Payne is well regarded as an extremely thorough and pragmatic litigator and strategist able to effectively utilise alternative dispute resolution to achieve commercially desirable outcomes and, where appropriate, the court process to the fullest extent for his clients.

  • Ongoing review and provision of advice to a major builder in the domestic building industry concerning the compliance of its advertising and marketing collateral with the Australian Consumer Law.
  • Advising retail and manufacturing clients in respect to the consumer guarantee provisions of the Australian Consumer Law.
  • Acting on behalf of a publicly listed Australian company in a dispute culminating in a two week hearing in the Supreme Court of Victoria, Australia, concerning the performance and valuation of a stock take undertaken in various business locations across Australia.
  • Acting in proceedings in the Supreme Court of Victoria, Australia in respect to a joint venture dispute concerning the acquisition and large scale development of premium housing allotments.
  • Acting for Black & White Cabs Pty Ltd in proceedings brought in the Federal Court of Australia by the Australian Competition and Consumer Commission (ACCC).
  • Acting for Bakers Delight in a major investigation by the ACCC involving allegations of unconscionable conduct and other breaches of the Trade Practices Act.
