Tara C. Garcia concentrates her practice in environmental law, including related litigation and regulatory compliance work concerning various state and federal environmental laws, such as CERCLA, the Clean Air Act, and the Migratory Bird Treaty Act. Ms. Garcia currently assists with the representation of sixty-one companies participating in the Lower Passaic River Study Area Cooperating Parties Group, which is engaged with federal and state agencies in a CERCLA study of the Lower Passaic River in Northern New Jersey. Ms. Garcia has prior experience in energy regulation, with a focus on renewable energy, and currently monitors energy developments on the Eastern seaboard. In addition, Ms. Garcia has broad-based litigation and regulatory agency experience in general criminal and commercial matters, with a focus on intellectual property, telecommunications, entertainment, and First Amendment jurisprudence.

Professional Background

Prior to joining the firm, Ms. Garcia was a litigation associate at an international law firm in New York, where she focused her practice on intellectual property, telecommunications, entertainment, and First Amendment jurisprudence.  While attending law school, Ms. Garcia was a research assistant for a prominent professor in energy law where she conducted research on energy transmission lines.  Ms. Garcia was also the Executive Editor of Ecology Law Quarterly, one of the nation’s most respected and widely read environmental law journals, and a legal intern at the California Energy Commission in Sacramento, where she worked primarily in the area of renewable energy.

Ms. Garcia was a member of the United States Marine Corps Reserve from 2004 through 2009, where she served as a Motor Transport Operator and Administrative Clerk.

Environmental, Energy and Natural Resources Matters
  • Part of the team responsible for drafting the California Energy Commission’s precedential decision concerning cultural resources located on proposed solar facility sites.
  • Represented agency personnel in rulemaking proceedings to amend existing regulations governing the California Power Source Disclosure Program.
  • Represented environmental non-profit organization in data sharing matter concerning Ecological Covertype Map (“ECM”) plot points and other natural resources data.
  • Represented the former owner of industrial site defending CERCLA and related state-law claims arising from subsequent site owner’s alleged disposal of hazardous substances at a separate facility.
  • Represents construction industry client in connection with claims for environmental indemnification.
  • Assists with the representation of sixty-one companies participating in the Lower Passaic River Study Area Cooperating Parties Group, which is engaged with federal and state agencies in a CERCLA study of the Lower Passaic River in Northern New Jersey.
First Amendment, Media, and Intellectual Property Matters
  • Filed a petition for a writ of certiorari with the United States Supreme Court on behalf of a reporter subpoenaed to reveal his confidential sources.
  • Drafted amendment to New York legislation in connection with First Amendment concerns of film industry client.
  • Represented telecommunications client in Federal Communications Commission matters and in civil litigation concerning inmate calling service rate disputes.
  • Advised non-profit organization on copyright issues in connection with documentary film project and drafted accompanying waivers, releases, and work for hire agreements.
  • Advised client on intellectual property rights in scientific data and drafted accompanying data sharing agreement.
  • Developed lesson plan and taught classes on the First Amendment to high school students at the Urban Assembly School for Careers in Sports.
