At the heart of our Social Media Law practice is a keen awareness of the role that social media plays in today’s business development and success. The practice is specifically designed to assist clients in maximizing social media to achieve business goals. At the same time, we provide our clients with critical guidance to ensure their social media uses conform with existing legal precedent, as well as regulations governing the fields of intellectual property, advertising and marketing, employer-employee relations, importing and exporting, corporate governance, and more. We also work closely with clients to craft effective litigation prevention strategies surrounding social media use, and draw upon our world-class litigation talent to vigorously protect business, proprietary, and personal interests if and when the need arises.

What We Do
Over the past several years, we have fielded an increasing number of inquiries regarding the application of current law to social media use, with a particular focus on social media’s impact on business creation, development, regulation, and marketing. Those inquiries have spanned our practice areas, implicating intellectual property, advertising, trade disparagement and defamation, discovery, privacy, employment law, securities law, and more.

As a direct response to this emerging legal market, we have woven together our vast resources to form a distinct Social Media Law practice. Through this team, we can serve a diverse range of client needs.

Worked on the “Billion Dollar Basketball Bracket” challenge in the spring of 2014, conducting an in-depth trademark search for the name, reviewing NCAA trademark guidelines, and assisting in advising the partner and client on Twitter and Facebook posts.
Working with the California attorney general’s Cyber Exploitation Working Group to develop technology and standards for preventing abuse on social networks, including dissemination of revenge porn and bullying.
Reviewed social media advertising campaigns for false advertising risks and for compliance with applicable requirements including social media platform rules and the Federal Trade Commission (FTC) Guidelines on Endorsements and Testimonials.
Monitor social media websites for clients as part of investigations into trademark and copyright infringement. Have succeeded in having clients’ intellectual property removed from these sites.
Counseled clients on corporate social media use and litigation prevention strategies in emerging social media issues in the Middle East.
Advise clients on trademark and copyright guidelines of major social media companies, including requests regarding usernames and use of the social media companies’ trademarks.
Advised clients on the UK crowdfunding law and the intersection between UK securities laws and social media usage by financial institutions.
Advised and trained broker-dealers and investment advisers on social media policies and procedures, as well as discrete compliance issues.
Advised depository and non-depository financial institutions on social media and other marketing issues, including drafting social media policies and procedures.
Advised major U.S. footwear producer on copyright implications and litigation prevention strategies with respect to multiplatform social media engagement.
