Ms. Hastings concentrates her practice in government enforcement and internal investigations. She has extensive experience representing banks, investment advisers, broker-dealers, and other financial institutions, public and private companies, chief compliance officers (CCOs) and other officers and directors, and accountants in enforcement investigations and examinations before the U.S. Securities and Exchange Commission (SEC), the U.S. Department of Justice (DOJ), the Financial Industry Regulatory Authority (FINRA), the Office of the Special Inspector General for the Troubled Asset Relief Program (SIGTARP), and other federal and state government agencies. Ms. Hastings also advises clients on corporate governance and regulatory and compliance matters, including developing effective policies and procedures for safeguarding material, nonpublic information (MNPI) and the handling of whistleblower complaints. She also represents clients in civil litigation matters in various federal and state courts. Some of her more significant matters include:

  • Represented large financial institutions in SEC investigations and examinations related to anti-money laundering (AML) compliance, conducted internal investigations focused on compliance with AML regulatory requirements, and assisted clients with the development of AML compliance procedures and processes.
  • Represented numerous financial institutions, banks, and officers in regulatory investigations related to asset-backed securitizations, including residential mortgage-backed securities, commercial mortgage-backed securities, and auto loan securitizations.
  • Represented banks, broker-dealers, investment advisers, and other financial institutions, public and private companies, chief compliance officers and other officers and directors in regulatory investigations and related litigation involving various issues, including: insider trading, market manipulation, fraud, the protection of material, nonpublic information, supervision, public disclosures, equity research, financial reporting, and fiduciary duties.
  • Investigated whistleblower complaints for public and private companies.
  • Conducted numerous internal investigations for a variety of companies and non-profit organizations, including for numerous financial institutions, a large defense contractor, a global consumer goods company, and a college.
  • Involved in a number of regulatory and litigation matters involving the False Claims Act.
  • Defended senior accounting officers in enforcement investigations and parallel federal securities class actions relating to insider trading, revenue recognition, financial disclosures, and other accounting issues.
  • Served as counsel to corporate committee responsible for reviewing shareholder derivative demands.
  • Served as counsel to public companies and individuals in class action litigation before various trial courts and appellate courts, including actions brought under Section 10(b) of the Securities Exchange Act of 1934 and Section 11 of the Securities Act of 1933.
  • Assisted in the preparation of U.S. Supreme Court amicus briefs for financial services firm.

Ms. Hastings serves as the D.C. office co-representative on the firm’s Women in the Profession Committee and is the co-head of the D.C. office Women in the Profession Committee. She is also one of the firm’s representatives to the National Association of Women Lawyers’ Challenge Club.

Ms. Hastings also leads various training and coaching initiatives within the firm’s Government Enforcement practice group and the D.C. office, including a monthly training program for young lawyers focused on passing along key skills and best practices in government investigations and internal investigations.

Professional Background

Prior to joining K&L Gates, Ms. Hastings participated in the Office of the Secretary of Defense Honors Legal Internship Program.  During her internship, she was selected for the Excellence in Government Award.   Prior to attending law school, Ms. Hastings worked for a management consulting firm supporting the Department of Defense Office of Interoperability and Ballistic Missile Defense Organization.
