Ms. Hardingham is an intellectual property (IP) lawyer with experience in the protection, management, exploitation and enforcement of IP rights including trade marks, copyright and designs. She has a broad range of litigation experience which includes IP matters as well as disputes regarding the misuse of confidential information, defamation, passing off and misleading and deceptive conduct.

Ms. Hardingham has acted for a range of clients including fashion and footwear brand owners, designers and manufacturers, designer builders, prolific Australian and international talent, publishers and record companies.

  • Acting for various prominent fashion brands in Australia including Diesel, G-Star, Camper and Zoo York as well as a wide range of leading Australian fashion labels including Seafolly, Review,Gorman, Arthur Galan, Bettina Liano, Scanlan & Theodore, Metalicus, Alice McCall, Anna Thomas and Elwood in a variety of IP matters. These have included matters relating to brand and design protection and litigious matters involving copyright, design and trade mark infringement, passing off and misleading and deceptive conduct.
  • Acting for Seafolly in a copyright infringement proceeding Seafolly successfully brought against Fewstone (City Beach) in the Federal Court of Australia. Seafolly was successful in establishing that Fewstone had infringed Seafolly's copyright in two fabric prints and an embroidery design applied to garments.
  • Advising a range of designer builders on issues relating to the protection, management and exploitation of IP rights and acting for such clients in disputes relating to trade mark infringement, misleading and deceptive conduct and passing off, including acting for Boutique Homes in two such proceedings issued in the Federal Court of Australia.
  • Acting for a range of designer builders in copyright infringement proceedings in the Federal Court of Australia, including as follows:
    • Acting in three successful copyright infringement proceedings in the Federal Court of Australia for pre-eminent Australian project home designer builder Barrett Property Group (trading as Porter Davis Homes). This comprised of two trials, two appeals before the Full Federal Court and successfully defending an application for special leave to appeal to the High Court of Australia.
    • Acting for designer builder Boutique Homes in successfully defending a copyright infringement proceeding brought against it by competitor Inform Designs Homes in the Federal Court of Australia.
    • Acting for designer builder Metricon Homes in copyright infringement proceedings in the Federal Court of Australia.
    • Acting for designer builder McDonald Jones Homes in a copyright infringement proceeding in the Federal Court of Australia.
  • Advising a range of furniture and lighting designers on issues relating to the protection, management and exploitation of IP rights, and acting for such clients in disputes relating to copyright infringement.
  • Acting for Liquid Engineering 2003 Pty Ltd in a successful trade mark proceeding in the Federal Court of Australia.
  • Acting for SNF (Australia) Pty Ltd in a patent revocation and infringement proceeding including in the appeal proceeding in the Federal Court of Australia and a proceeding issued in the High Court of Australia.
  • Acting for of Google Inc. and YouTube, LLC in a variety of trade mark and domain name dispute matters, including successful trade mark opposition proceedings and domain name dispute proceedings via WIPO.
  • Acting in proceedings issued in the Federal Court of Australia for businesses against former employees who have misused their former employer's IP and trade secrets.
