Mr. Mixon has a broad practice focused on public pension plans, sovereign wealth funds, and other public entities. As a member of the firm’s institutional investor group, he concentrates on trust law in the context of investments, governance, operations, and regulatory investigations. Mr. Mixon advises his clients on public and private market investment contracts and he also has extensive experience advising public boards and committees on governance and fiduciary issues. Mr. Mixon has testified in state court as an expert on public pension fiduciary standards.

Professional Background

Mr. Mixon began his career in private practice in 1985, representing public and private entities in business and constitutional litigation.

Prior to joining K&L Gates, Mr. Mixon served as General Counsel for the California Public Employees’ Retirement System for eleven years. As in-house counsel, Mr. Mixon provided counsel to the Board and Chief Executive Officer on all aspects of investments, operations, strategy, and governance including the following:

  • He advised the Board and staff on fiduciary aspects of plan funding, asset and liability valuation, and collection rights and litigation;
  • He provided extensive advice on all types of investment transactions, including private equity, real estate, venture capital, and hedge funds;
  • He provided legal advice on the Board’s Corporate Governance Program, effectively guiding engagement on majority voting, proxy access, and other governance issues;
  • He advised the Board on placement agent issues and drafted California state legislation regulating disclosure and fees;
  • He advised the staff on public disclosure laws including legal rights and responsibilities and he supervised the defense of several lawsuits brought under the California Public Records Act; and
  • He supervised a comprehensive Board Governance Project, substantially improving the effectiveness, efficiency, and accountability of the Board and staff.
