Nolan R. Hubbard is a PTO-registered patent lawyer with a background in electrical engineering.  He concentrates his practice on intellectual property law focusing on patent prosecution, litigation, counseling, opinion work and due diligence in a wide range of technological areas including electrical, software, and business method inventions.

Mr. Hubbard handles domestic and foreign patent prosecution matters, drafting and prosecuting patent applications through to issuance.  Mr. Hubbard’s experience includes appeals before the Patent Trial and Appeal Board, as well as strategic reissue and reexamination proceedings.  He advises clients on all aspects of prosecution and portfolio management, including strategic counseling for global intellectual property portfolios with utility patents, trademarks, and design patents.

Mr. Hubbard has worked with large global corporations and small start up companies to prosecute inventions in a wide array of technologies including medical devices, patient safety systems, enteral feeding and gastric decompression systems, pump controls, LCD technologies, transistors, capacitors, touch screens, power systems, microscopy, wireless communication, speech recognition, virtual machines, satellite systems, machine learning, fiber-optics, encoding, compression, payment systems, data transmission and storage, synchronization, memory management systems, antennas, magnetic filters, commercial transportation and shipping systems, sterilization systems, health and cosmetic appliances, sporting equipment, and educational systems.

Mr. Hubbard has been involved in numerous litigations in U.S. district courts and in the U.S. International Trade Commission.  The patented technologies litigated involved medical devices, image processing, camera interface technologies, financial transaction security systems, computer interoperability systems, retail and home security systems, health care services, sporting equipment, and power tools.  Mr. Hubbard’s experience includes infringement and invalidity analysis, fact discovery, motion practice, expert reports, claim construction briefs, and pre-trial and post-trial briefs.

Mr. Hubbard counsels clients on various other patent related issues and performs due diligence and opinion work.  He has prepared noninfringement, infringement, invalidity, intervening rights analysis and opinions relating to dialysis systems, power systems, microprocessors, internet advertising, online music services, flow meters, and wind turbines.  He has performed a large scale freedom to operate analysis for a flagship product and monitored reexamination and litigation activities of both competitors and non-practicing entities.  Mr. Hubbard has also performed analysis and negotiation preparations for patent portfolio acquisitions from the buyer’s side and the seller’s side, including due diligence analysis on both small and large patent portfolios totaling hundreds of U.S. and foreign patents and applications, including analysis relating to infringement, validity, ownership, and portfolio flexibility.

During law school, Mr. Hubbard clerked at a patent litigation boutique, where he assisted counsel with motion practice, claim construction and summary judgment briefing, discovery preparation, witness preparation and depositions, patent infringement and invalidity analyses, and legal research.
