Ms. Tea concentrates her practice in the area of commercial disputes, representing clients nationwide in a variety of industries, including manufacturing, metals, specialty chemicals, industrial equipment, health care, consumer products and financial services. She also has significant experience in the insurance coverage area, representing policyholders in coverage disputes relating to environmental, toxic tort, business interruption, product liability and first party property losses. Ms. Tea also counsels clients facing mass tort claims pending in jurisdictions throughout the United States.

Commercial Disputes

  • Morales v. Alcoa Inc. Obtained summary judgment dismissal of negligence and respondeat superior claims against alumina manufacturer in a personal injury matter.
  • Alcoa Inc. v. Niagara Worldwide, LLC. Obtained judgment in favor of aluminum manufacturer following a bench trial on a replevin claim arising out of a purchase and sale agreement. Argued the matter on appeal and the judgment was affirmed.
  • The Dow Chemical Company v. NOVA Chemicals. Represented chemical company at trial on standing issues and on appeal in patent infringement case.
  • DL Resources, Inc. v. FirstEnergy Solutions Corp. Represented energy company at bench trial involving claims for breach of contract, misrepresentation and tortious interference with contractual relations arising from a natural gas purchase agreement.

Insurance Coverage

  • Represents Ashland Inc. in obtaining coverage for environmental, product and toxic tort liabilities.
  • Continental Insurance Company v. Honeywell Intl. Inc. Represented friction materials manufacturer seeking insurance coverage for asbestos-related bodily injury claims. The matter proceeded to trial before a special allocation master, which resulted in a judgment in Honeywell’s favor.
  • Travelers v. Honeywell Intl. Inc. Represented refractory materials manufacturer in obtaining coverage for asbestos-related bodily injury liabilities.
  • Represented Duke Energy Indiana Inc. in obtaining coverage for asbestos-related bodily injury liabilities.

Health Care Litigation

  • In a case of first impression, obtained summary judgment on behalf of a consortium of hospitals in litigation involving application of federal sequestration laws.
  • Represents numerous health care providers in disputes with insurers regarding reimbursement rates and other contractual issues.

Toxic Tort Litigation

  • Member of the national asbestos trial team for Honeywell Intl. Inc.
  • Counsels clients facing multi-district toxic tort claims in a national coordinating counsel capacity.
