Ms. Aitken advises clients in the public and private sectors across a broad range of industries, including health, education, insurance, transport and logistics, sports and government. She assists clients to navigate the many stages of the employment relationship, and has experience providing strategic advice in relation to contractual issues, entitlement disputes, restraint of trade, redundancy, restructuring and workforce planning, enterprise and other collective bargaining agreements, award coverage, employee performance and misconduct, and managing ill and injured employees.

Ms. Aitken also has experience assisting in the defence of complex unfair dismissal and general protections claims.

Professional Background

Ms. Aitken joined K&L Gates as a graduate in 2015 and has also completed rotations in the Insurance Litigation and Commercial Transactions and Outsourcing teams.

  • Assisting a state government department in the defence of a protracted and complex unfair dismissal proceeding, including providing detailed advice on covert recordings, model litigant obligations and potential remedies. 
  • Developing and customising materials for employees and managers of a government department to refer to when conducting serious misconduct investigations, including developing practical flow charts, checklists and templates for use during the investigation process. 
  • Assisting a client in the transport and logistics industry to defend a dispute brought by the union arising out of the abolition of a position. 
  • Providing advice to clients in the health sector in relation to compliance with redundancy provisions in workplace restructuring.
  • Assisting with providing advice to a publically listed company on the potential criminal liability of an employee arising from the unauthorised deletion of a significant number of company records under the Corporations Act and commonwealth and state criminal Acts.
  • Providing assistance to a client in an unfair dismissal proceeding involving migration, 457 visa and underpayment issues and assisting with the successful defence of the appeal.
  • Assisting in the defence of general protections and unfair dismissal claims for public sector and community service organisations. 
  • Assisting a client in the education sector to manage the return to work of an ill employee facing criminal charges, including providing advice on requirements in relation to holding a valid Working with Children Check.
  • Assisting with the representation of 21 law firms in their application for variations to the Legal Services Award 2010 as part of the 4 yearly Modern Award Review.
  • Assisting a commonwealth authority with their award modernisation application. 
  • Assisting to prepare workplace behaviour training materials and presentations for an employer in the sports industry.
