Ms. Garraux is an experienced commercial litigator. She takes a proactive approach to representation, working with clients to understand their needs and concerns, identifying potential risks and areas of exposure, and tailoring solutions to address those issues and support and further her client’s interests.

Ms. Garraux represents clients in a wide range of business disputes in state and federal courts across the country and is admitted to practice in Pennsylvania, Delaware, and Florida.

Prior to joining K&L Gates, Ms. Garraux practiced law in Philadelphia, Pennsylvania and Wilmington, Delaware.

Community and Pro Bono Activities

  • Ms. Garraux is a member of the Parents Advisory Committee of Magee-Womens Hospital’s Neonatal Intensive Care Unit (NICU), a group that supports parents and family members with children in the NICU.
  • Ms. Garraux is involved in the firm’s Cyber Civil Rights Legal Project, a global K&L Gates pro bono project that provides legal services to victims of nonconsensual pornography (i.e., “revenge porn”) when their sexually explicit images are distributed and displayed online without their consent.

Commercial Disputes

  • Obtained appellate affirmance of judgment in favor of aluminum manufacturer on a replevin claim arising out of a purchase and sale agreement.
  • Represented state supreme court candidate in fast-paced challenge to application of public campaign financing program involving issues of first-impression.
  • Represented financial services company and individual investment managers in arbitration proceeding before FINRA and obtained dismissal of all claims against them.
  • Represented a financial institution in multi-district federal court and bankruptcy court litigation brought by several former investment advisory clients, alleging fraud and civil RICO for losses incurred by the investment advisory clients arising from a billion dollar Ponzi scheme in which the investment advisory clients had invested, while simultaneously conducting an internal investigation of the circumstances giving rise to the claims.
  • Represented target and acquiring companies in challenges to proposed mergers by classes of shareholders.
  • Represented chairman of private company in Delaware Chancery Court and obtained injunctive relief preventing dissident shareholders from dissolving company.
  • Defended national investment advisor in litigation arising out of multi-million dollar subprime losses in a fixed income fund of a leading institutional asset manager.
  • Represented securities industry clients with respect to regulatory investigations and examinations involving asset-backed and mortgage-backed securities.
  • Represented retail industry client in action involving claims of trademark infringement, commercial disparagement, and unfair competition.

Bankruptcy, Insolvency and Creditors’ Rights

  • Represented Chapter 11 debtors, Chapter 7 trustees and secured and unsecured creditors in various bankruptcy matters.
  • Defended financial institution in multi-district federal court and bankruptcy court litigation commenced by former investment advisory clients alleging fraud and civil RICO claims exceeding one billion dollars.
  • Conducted an investigation of claims against private equity investment firm and directors and officers of debtor corporation on behalf of Chapter 7 trustee.
  • Represented non-profit hospital in highly-contested litigation relating to perfection of security interests in collateral and its proceeds under the Pennsylvania Uniform Commercial Code.

Healthcare Litigation

  • Counsels and litigates on behalf of health care providers in a variety of matters, including reimbursement disputes with health insurance companies under ERISA and defense to insurer recoupment demands.
  • In 2016, led a cross-office team of K&L Gates lawyers in drafting a chapter titled “Health Care Institutions” in Business and Commercial Litigation in Federal Courts, Fourth Edition, the latest edition of the treatise from Thomson Reuters. The chapter discusses federal court litigation relating to health care institutions and providers of health care services and covers a number of timely topics in this area of the law, including reimbursement disputes between health care providers and commercial payors; privacy, HIPAA and data security breach litigation; fraud-related litigation under the False Claims Act, the Stark Law and the Medicare Anti-Kickback Statute; and private and government antitrust litigation.

Product Liability

  • Obtained unanimous defense jury verdict for steel coil processing equipment designer, manufacturer, and seller in product liability action stemming from accident in which operator’s left hand was crushed by a component of steel coil slitting line.
  • Obtained unanimous defense jury verdict for child car seat designer in product liability case involving four-year-old plaintiff.
