Ms. Rich is an associate in the litigation department of the firm’s Boston office. She focuses her practice on general civil and commercial litigation matters. Ms. Rich has represented a variety of corporate and individual clients in contract, labor & employment, insurance coverage, tort, and general business litigation matters in federal and state courts. Ms. Rich also has experience representing clients in the areas of securities enforcement and products liability and has assisted in internal investigations.

Ms. Rich has participated in a variety of state and federal court proceedings, including jury and bench trials, arbitrations before the American Arbitration Association and FINRA Dispute Resolution, mediations, and proceedings before the Appellate Tax Board. Her representations include litigation arising under state statutory law (including state unfair and deceptive acts and practices statutes and wage statutes) and state common law (including contract, tort and insurance coverage). She has also advised clients with regard to a wide range of employment issues and has assisted clients with the drafting of various types of employment documents. Ms. Rich has managed extensive discovery for clients, including written discovery and complex discovery issues related to electronically stored information.

Professional Background

Prior to joining K&L Gates, Ms. Rich interned with the University Counsel’s Office at Northeastern University and with the Health and Disability Unit at Greater Boston Legal Services. She was a summer associate at K&L Gates in 2010.

  • Represented supermarket chain and various committees of its board of directors in connection with lawsuits and/or various disputes involving shareholders, directors, officers, and employees.
  • Represented composite decking manufacturer in connection with insurance coverage dispute with manufacturer’s commercial general liability (CGL) insurers. Representation resulted in favorable settlement for policyholder and contemporaneous settlement of underlying matter after defeat of insurers’ motions for summary judgment.
  • Represented software supplier in breach of contract dispute against customer in connection with a software license agreement in which customer asserted various counterclaims in response to supplier’s lawsuit. After moving for summary judgment on its affirmative claim and for dismissal of counterclaims contemporaneously, the Superior Court found in wholly in favor of supplier, eliminating the need for any discovery.
  • Represented asset manager and two of its hedge funds in FINRA Arbitration and secured a $1.65 million dollar award, including $400,000 in attorney's fees, statutory interest, and expert fees.
  • Represented national bank in litigation concerning construction loans and personal guaranties. During the course of the litigation, K&L Gates successfully served summary judgment on all of its affirmative claims and attachments on the assets of the defendants. After trial, the Massachusetts Superior Court found in favor of the bank on defendants remaining claims and entered judgment in favor of the bank in the amount of $14 million, plus interest and attorneys’ fees. Following judgment, the Massachusetts Appeals Court denied defendants’ appeal and affirmed the trial court’s judgment in its entirety.
  • Defend national mortgage loan service in putative class actions addressing disclosures in loan modification agreements.
  • Conducted internal investigation of the quasi-public agency in order to assess litigation risks and compliance issues.
  • Represented West Virginia University in litigation concerning WVU’s departure from The Big East Conference, which ultimately resulted in a settlement that allowed WVU to become a member of The Big 12 Conference for the 2012-13 season.
