Ms. Hauser acts for a variety of clients within the energy and utilities sectors including renewable energy developers, energy retailers, network service providers and large electricity generators. Some of her key areas of focus include acting on the development of wind farm projects and advising energy retailers on regulatory and contractual matters. Ms. Hauser also has experience advising other energy industry participants across a range of commercial, operational and compliance matters.

Professional/Civic Activities

  • Ms. Hauser is engaged in pro bono work, including volunteering at the St John's Legal Centre in Sydney.
  • Acting for a hydro project developer and operator on the preparation of its bid for the purchase of the hydro and wind assets of a corporation owned by the New South Wales Government, including reviewing data room documents and preparing a legal due diligence report in relation to the transaction.
  • Drafting energy retail customer contracts for both small and large customers for Australian energy retailers. 
  • Advising energy retailers on a range of regulatory compliance matters, including comparative analyses of regulatory approaches in various jurisdictions, and drafting and advising on contracts and marketing collateral in light of statutory obligations. 
  • Providing advice to electricity network service providers in relation to various aspects of their regulatory roles and responsibilities, including assessing compliance issues and the consequences of non-compliance. 
  • Drafting an electricity connection agreement and operating protocol for an electricity network service provider and analysing and advising on associated regulatory issues. 
  • Drafting and advising on electricity metering services agreements for both electricity retailers and metering service providers, including considering and analysing relevant regulatory obligations. 
  • Advising on electricity feed in tariff schemes in New South Wales and South Australia, including detailed analysis of the operation of the schemes and the obligations of eligible customers, retailers and distributors and drafting associated customer contracts. 
  • Drafting and advising on a services agreement for the performance of current transformer testing, including consideration of the regulatory obligations for such testing. 
  • Advising a state owned corporation on issues arising from the privatisation of its energy retail business. 
  • Drafting and advising on an agreement for the relocation of a network service provider's assets for a major infrastructure project, and advising on associated issues including the contestable works framework in New South Wales. 
  • Drafting a high level agreement for the construction of a trench under a railway line to be used as a shared cable trench by a network service provider and a third party.
  • Advising clients in relation to the development of numerous wind farm projects, including advising on issues relating to land tenure, planning and environment, construction and native title and drafting and negotiating options, leases, easements, other agreements for various interests in land for wind farm sites and relevant infrastructure (including substations), associated services agreements, an early works construction contract and preparing caveats and relevant consents. 
  • Advising the proponent of a wind farm project in relation to the implementation of development consent conditions relating to the acquisition of neighbouring properties, including drafting and negotiating contracts for the sale of land and deeds of settlement, advising on a binding land valuation determination, including preparing submissions to an expert valuer and interpreting development consent conditions, drafting and negotiating agreements for easements with neighbouring property owners and advising on and implementing the exercise of options for the purchase of land. 
  • Drafting and advising on a lease and easements for a hydro power station and associated infrastructure.
  • Drafting and advising on leases and easements for solar system sites and associated infrastructure for a residential solar project. 
  • Preparing due diligence reports for corporate and energy industry clients, including due diligence review of construction contracts in relation to a corporate restructure. 
  • Advising on various statutory "green" schemes, including the implications of electricity generators' commercial arrangements for liability under such schemes. 
  • Advising on a range of other regulatory and commercial issues in the energy sector, including metering, pricing and access.
