Joanna Łagowska represents contractors and subcontractors in disputes arising from construction contracts and other disputes in the construction and engineering industry. She regularly represents Chinese entrepreneurs investing in Poland and advises on complex international disputes, bank guarantees and court proceedings under FIDIC. She also has extensive experience in arbitration, dispute resolution and patents, including advice on sales, lease agreements, corporate disputes, claims on account of infringement of patents, trademarks, and copyrights.

Professional Background

Prior to joining K&L Gates, Ms. Łagowska was an infrastructure and engineering disputes partner at another Warsaw law firm. She has particular experience in arbitration, disputes resolution, patents, trademarks, and copyrights.

Arbitration

  • Counsel for Korean Aerospace Industries in arbitration under ICC rules in a dispute over a sale agreement of helicopters.
  • Counsel for a German Fund in arbitration before KIG in a dispute over lease agreements.
  • Participation on behalf of Vivendi in an arbitration regarding a complex legal issue of compensation of indirect damages before LCIA, the disputed amount reached 3.1 billion PLN

Dispute Resolution

  • Representing the contractor of A2 Motorway in litigation with the Investor - State Treasury- GDDKiA - arising from performance of an agreement for design and construction of A and C sections of A2 Motorway in the “design - build” system based on the FIDIC model of 1999 (value of claim PLN 130 million). 
  • Representing a consortium in numerous construction disputes with subcontractors and service providers (approx. 50 disputes),
  • Representing a contractor in disputes with a bank and an investor for payment of dues under a bank performance bond (value of claims approx. PLN 60 million).
  • Representing entities in bankruptcy proceedings.
  • Advising a consortium on cross-border disputes arising from a bank guarantee.
  • Advising contractors on pursuit of claims under an agreement for repayment of certain unpaid entrepreneurs’ dues arising from performance of public procurements.
  • Advising contractors on consortium agreements.

Patents, trademarks and copyrights

  • Disputes between Bioton and NovoNordisc regarding patent infringement.
  • Disputes between ZAIKS and Hekon Hotels regarding payment of authors’ remuneration for playing music.
  • Representation in disputes between PGE and a software company regarding software deficiencies.
  • Prepared opinions regarding admissibility of parallel import of pharmaceuticals.
  • Invalidation of trademarks before the Polish Patent Office.
  • Prepared an opinion ordered by Ministry of Commerce on legal, social and financial consequences of accession by Poland to London Protocol to European Patent Convention (co-author along with Prof. Krystyna Szczepanowska - Kozlowska).
