Jake Ferm is an associate in the Complex Commercial Litigation and Disputes practice in London. 

Mr. Ferm has experience of a wide range of commercial disputes across a number of industries, the majority of which have a significant cross-border element. He has acted in High Court litigation, and disputes involving mediation, expert determination and arbitration (both commercial and investor-state).

High-Court Litigation

  •  Defending a high-net-worth individual in complex cross-border c. £10 million High Court proceedings concerning a number of allegations, including fraud, conspiracy and breach of directors’ duties.
  • Urgent High Court proceedings in respect of data rights in the betting and gaming industry.
  • Achieving multi-million pound recoveries from former directors and associates of a fraudulently-run former payroll company, acting for the liquidators.
  • Jalal Bezee Mejel Al-Gaood -v- Innospec Ltd (2014): acting for a global chemicals company in its successful defence of a Commercial Court $42 million bribery follow-on claim, the first of its kind.
  • Acting for a large Asian government agency on the enforcement of a £15 million arbitration award.

Investor-State Arbitration

  • Corona Materials LLC -v- Dominican Republic (2016): $250 million investor-state arbitration claim under the DR-CAFTA treaty arising out of the alleged expropriation of mining rights by the Dominican government. Lead associate on case: drafted pleadings and witness statements; interviews and liaison with clients culminating in 2-day hearing at the World Bank in Paris.
  • Advising on anticipated ad hoc arbitration proceedings against a multinational NGO in a contract governed by lex mercatoria.

Commercial Arbitration

  • Representing a market-leading tech company facing a $25 million LCIA arbitration claim concerning disputed earn-out payments to the sellers of a recently acquired start-up, achieving favourable settlement.
  • LCIA gas price review arbitration under a long-term LNG supply agreement for a major European oil and gas company.
  • $250 million ICC arbitration acting for a leading supplier of security equipment against a Southern European nation state.

Other Experience

  • M&A: Acting and advising on numerous claims under warranties and indemnities in Share and Asset Purchase Agreements.
  • Insurance: Advising numerous clients on insurance policy wordings and pre-policy disclosure under the Insurance Act 2015.
  • Internal Investigations: Advising and assisting on internal investigations, including in cases involving the SFO and FCA.
  • Pro bono: advisor at Battersea Legal Advice Centre and the Royal Courts of Justice Citizens Advice Bureau.
