Hubert Wysoczański is a member of the Dispute Resolution and Arbitration practice, and also the Energy and Environment Team. His practice focuses on commercial and construction litigation (i.a. the FIDIC contracts), public procurement law, as well as commercial and investment arbitration.

His practice also includes advising clients in energy projects and disputes (preparation of the investment process and grid interconnection agreements). He also advises on administrative and court proceedings regarding environmental permits, planning and zoning permissions, and building permits, particularly in the renewable energy sector.

Hubert has advised on a number of energy projects, including 27 wind farms. He has participated in matters important for the shaping of the renewable energy market in Poland, such as advising on the development of the first off-shore wind farm projects. Hubert has also counseled on a number of large infrastructure projects, including roads, highways and mines.

Professional Background

Prior to joining K&L Gates, Mr. Wysoczański gained experienced in the Warsaw office of another international law firm, in the Commercial Disputes and Arbitration department. Previously he worked at the Legal Clinic of the Jagiellonian University in Krakow, in the Civil Law Section. He also did an internship with the Commercial Division of the Regional Court in Krakow, where he dealt with unfair competition cases.

  • Winner of the First Prize in the competition of the Commercial Law Review (Przegląd Prawa Handlowego) and Wolters Kluwer for the best master thesis in the field of commercial law, for the paper: "The Impact of the Common Law System on the Use of FIDIC Conditions of Contract in Civil Law Jurisdictions. Energy

  • Advised on a variety of matters related to 27 wind farm projects, with a total capacity of approx. 3300 MW.
  • Advised foreign and domestic investors on offshore wind power plant projects in Poland with a total capacity exceeding 2000 MW, including, i.a., obtaining offshore permits under the new Maritime Areas Act and during the competitive procedure.
  • Advised investors in ground-breaking disputes concerning wind farm grid interconnection agreements before the President of the Energy Regulatory Office, the Competition and Consumer Protection Court, and the Appellate Court in Warsaw.
  • Advised over 20 wind farms investors in administrative and court proceedings concerning environmental permits, zoning permissions, zoning plans, building permits and ecological surveys, complains over excessive length of administrative proceedings.
  • Participated in negotiations of a tripartite contract of sale of rights and obligations related to a 17,5 MW wind farm project, including transfer of administrative decisions and permits.
  • Advised a Spanish company constructing power lines projects in negotiations and disputes with the Employer.
  • Advised a land owner in court disputes over utility servitude and claims against the powerline company regarding compensation for unlawful usage of land.
  • Advised investors in wind farm projects in administrative and court proceedings instigated by ecological organisations in ordinary and extraordinary procedures.
  • Advised a Canadian company on environmental damage liability related to a purchase of a contaminated galvanic plant facilities.
  • Participated in 12 due diligence projects involving wind farms (both for the seller and the buyer), analyzing in particular the environmental issues, environmental permits and administrative and court proceedings.
  • Provided advice to foreign and domestic energy companies on a broad range of environmental issues involving environmental impact assessments, acoustic impact analysis, and planned development of energy sources in Poland.
  • Advised investors in interconnection of energy receivers to internal grids of conventional energy plants
  • Prepared EU directives implementation projects for the renewable energy sector associations and governmental bodies.

Commercial disputes
  • Advised a number of contractors against employers in state court and arbitration proceedings in disputes based on the FIDIC Contracts.
  • Advised foreign construction JVs in disputes against the General Directorate for National Roads and Motorways (GDDKiA) concerning the construction of motorways in Poland, also in interim measures proceedings both before Polish and foreign courts.
  • Advised a Portuguese company in arbitration against a JV partner related to claims after the completion of a public procurement contract for an expressway.
  • Advised a US company in preparation of a general subcontract for construction works.
  • Advised a Canadian company on matters of international investment treaty protection and investment arbitration with regard to a mine construction project in a Central European state.
  • Advised an international telecommunication service provider in a number of court proceedings against other service providers in the Polish market.
  • Advised a large Polish coal mining company in an administrative proceeding regarding access to geological documentation.
  • Advised in matters related to the construction of the first liquefied natural gas (LNG) terminal in Poland.
  • Advised JV members in a dispute with the Employer over a railway line and station modernisation project.
  • Advised a Polish city in a dispute with the Contractor over FIDIC Conditions of Contract (binding force of Dispute Adjudiction Board decision) and public procurement law.
  • Advised the world’s most innovative ceramic tile factory in court proceedings against the Polish Agency for Enterprise Development regarding refusal to pay co-financing subsidies under the Operational Programme - Innovative Economy.
  • Advised a landlord in a lease contract for US Consulate over issues of the governing law of the contract and dispute resolution provisions.
  • Representation of a Cyprus-based company in international arbitration regarding the sale of a wind farm
