Mr. Peterson focuses his practice on insurance coverage and commercial disputes, covering a wide range of corporate, commercial and personal injury related disputes in Western Australia and Victoria.

His experience includes acting for various: 

  • insurers and insureds in relation to a wide range of public liability, workers’ compensation, product liability, asbestos and property related claims; and
  • commercial clients in relation to various contractual disputes, applications for injunctions and Anton Pillar orders, construction disputes, insolvency and recovery and consumer law matters.

Professional Background

Prior to joining K&L Gates in early 2013, Mr. Peterson worked as an insurance coverage and commercial disputes lawyer for a national Australian law firm for over 3 years and, prior to that, worked as a lawyer at a boutique insurance litigation law firm for over 3 years where he worked on a number of insurance and commercial disputes.

Insurance coverage
  • Representing non-employers in relation to public liability claims and s 138 recovery actions by the VWA. 
  • Representing employers in relation to workers' compensation and common law claims by injured employees and the recovery of workers' compensation payments from third parties.
  • Representing workers' compensation and public liability insurers in relation to various personal injury claims. 
  • Reviewing Australian and US liability insurance policies and advising on potential insurance coverage issues. 
  • Negotiating and managing insurance claims by insureds with their insurers and settling claims with insurers for reimbursement of defence costs.
  • Advising clients in relation to workers' compensation issues regarding the use of partnership arrangements in lieu of traditional employment arrangements.
  • Representing Safe Labour Hire Pty Ltd in relation to choice of law issues in Di Paolo v Salta Constructions Pty Ltd & Ors [2015] VSC 31 and [2015] VSCA 230.
  • Representing the property insurer of a shopping centre in recovery proceedings relating to the cost of repairing the collapse of the roof of the shopping centre.

Commercial disputes and other matters

  • Representing parties to disputes between former employers and employees involving applications for:
    • Anton Pillar orders to recover confidential information; and 
    • injunctions to enforce restraints of trade and protect confidential information.
  • Appearing as junior counsel for Adamus Resources in Hightime Investments Pty Ltd v Adamus Resources Ltd [2012] WASC 295. 
  •  Representing successful applicant for an injunction to prevent an extraordinary general meeting of members in Ngarmula Tharndu Karrungu Maya Ltd v Ngarluma Aboriginal Corporation RNTBC [2014] WASC 79. 
  • Representing an intervener in a Cross-Border Insolvency Act dispute. 
  • Representing a head contractor in relation to an arbitration and adjudication with a sub-contractor regarding delays to sheet piling works in regional Western Australia.
  • Representing parties to contracts for the provision of mining accommodation in regional Western Australia.
  • Representing an internet domain registration company in relation to allegations of breaches of the Australian Consumer Law for providing unsolicited services.
  • Representing parties to applications to set aside statutory demands.
  • Recovery of debts.
