Joshua C. Carpenter

Joshua Carpenter is a partner in the firm’s Miami office, where he provides multi-faceted service to global and local clients in the marine, transportation, and hospitality sectors, including recreational boat and boat component manufacturers and dealers, trucking and freight companies, and hotel and restaurant chains. Josh is a member of the firm’s Maritime and Commercial Disputes practice groups with a wealth of experience litigating and arbitrating complex and high-stakes cases in both state and federal courts across the United States in a number of practice areas, with a particular emphasis on negligence, products liability, and warranty and contractual disputes. Josh has first-chair trial experience and has tried a case to verdict in federal court and to arbitration award. Josh also assists and advises his clients in complying with applicable regulations, structuring minor transactions, and drafting warnings and tutorials to minimize risk.  

In his recreational marine practice, Josh represents boat and boat engine manufacturers and retailers in various matters typically including warranty claim disputes, product liability and wrongful death claims, product recalls, dealer/customer disputes, manufacturing quality and regulation compliance, and sales contract disputes.  

In his hospitality practice, Josh assists clients in contract disputes, insurance matters, corporate governance, and regulatory compliance. The bulk of these representation involve high-dollar contract disputes related to corporate cancelations, including disputes related to force majeure related to the Zika virus outbreak in South Florida, which has provided significant insight on how to navigate COVID-19 pandemic contract cancelations.

In his transportation practice, Josh frequently represents a publicly traded transportation company in a variety of personal injury and property damage disputes. In this capacity, he has successfully litigated claims involving multi-million dollar damages resulting from catastrophic injuries. These cases routinely involve litigation focused on agency and/or dangerous instrumentality doctrine.

Josh also has significant experience representing clients in construction and energy disputes, including the defense of major roadway construction contractors in conjunction with the building of a major interstate highway, and multiple successful arbitrations related to the construction and installation of solar panels.

Josh has been recognized by his peers as one of “The Best Lawyers: Ones to Watch,” and recently received an award from the Florida Daily Business Review as “Most Effective Counsel” for his pro bono representation of a Florida prisoner in a religious civil rights case.

Prior to joining the firm, Josh served as a law clerk for Chief Judge Leslie B. Rothenberg at Florida’s Third District Court of Appeal. After clerking, he spent several years as a litigation associate for a full-service global law firm where he focused primarily on complex multi-district litigation in the pharmaceutical and medical device field. Josh also has significant experience litigating health care disputes, fraud-based claims, bankruptcy issues, arbitrations, and in all aspects of the appellate process.
