Emily Tabak concentrates her practice in federal and state environmental law, including various administrative and enforcement matters involving regulatory compliance, permitting, and litigation. She advises clients identified as Potentially Responsible Parties at Superfund sites around the country; conducts internal investigations on environmental matters; and provides advice on permitting and regulatory requirements under the Clean Air Act and the Resource Conservation and Recovery Act. Her pro bono experience includes assisting a non-profit nature preserve on issues related to the Migratory Bird Treaty Act and state statutory and regulatory regimes. In addition, Ms. Tabak has broad-based litigation and regulatory agency investigation experience in general criminal and commercial matters.

Professional Background

Prior to joining K&L Gates, Ms. Tabak was a litigation associate at a law firm in New York, where she focused her practice on securities, white collar, contract, real estate, and bankruptcy matters, as well as regulatory agency investigations. Prior to that, she served as a law clerk to the Honorable Robert Kirsch, Superior Court of New Jersey.

  • Represents chemical and manufacturing companies as Potentially Responsible Parties and group members at various Superfund sites, advising on regulatory and administrative matters.
  • Represents a major retailer on disposal of hazardous waste regulations under the Resource Conservation and Recovery Act (RCRA) and various state regimes.
  • Represents a manufacturing company on Clean Air Act (CAA) issues including permitting and agency negotiations, as well as advising on hazardous waste transport requirements.
  • Represented a non-profit nature preserve related to its possession of migratory birds.
  • Represented a quarry operator in an environmental litigation related to Spill Compensation and Control Act and Environmental Rights Act claims.
  • Represented a hedge fund portfolio manager in a conspiracy and securities fraud trial before the United States District Court for the Southern District of New York.
  • Conducted an internal investigation on behalf of the Official Committee of Unsecured Creditors of a financial service company focusing on residential estate loans, resulting in a $2.1 billion settlement.
  • Conducted internal investigations on behalf of mortgage servicing companies related to inquiries by the Securities and Exchange Commission and the Consumer Financial Protection Bureau.
  • Represented a debtor dry bulk goods shipping company in a shareholder committee suit culminating in an evidentiary hearing before the Southern District of New York, United States Bankruptcy Court.
  • Represented the New York City Law Department during depositions related to alleged police misconduct and tort claims.
  • Represented a victim of domestic violence in Bronx County Family Court in successfully doubling her child support award, and in negotiating a one-year order of protection and a final order awarding the client full custody of the parties’ two children.
