Cassandra Payton is an associate in the firm’s Los Angeles office. Her practice focuses on complex commercial litigation, and Ms. Payton frequently represents companies across various industries in litigation involving commercial disputes, consumer class actions, intellectual property, and labor and employment. Ms. Payton frequently represents clients in both state and federal court. She has significant experience with all phases of litigation including motions to dismiss, preparing and responding to discovery requests, depositions, motions for summary judgment, motions for class certification, trial, and post-trial motions.

Ms. Payton's consumer class action defense experience includes litigating claims brought under the California Invasion of Privacy Act ("CIPA") and the Telephone Consumer Protection Act (“TCPA”). Ms. Payton also has experience representing clients in lawsuits involving claims brought under state consumer protection and false advertising statutes.

In the area of employment law, Ms. Payton also has experience counseling clients on employment issues before they become disputes. In the area of restrictive covenants, trade secrets, and arbitration, Ms. Payton drafts and interprets the enforceability of contracts containing these provisions. Ms. Payton also counsels employers on making day-to-day employment decisions to ensure compliance with applicable employment laws and regulations.

Before joining K&L Gates, Ms. Payton served for two years as a judicial law clerk to the Honorable Raner C. Collins of the United States District Court for the District of Arizona. There, she gained significant experience in federal civil procedure and numerous substantive areas of law. Ms. Payton worked on cases involving class action claims, trademark, employment discrimination, housing discrimination, claims brought under the Federal Tort Claims Act, insurance coverage, and breach of contract.

Speaking Engagements

  • Speaker, "Kickstarter: Investing in the Right Extracurricular for You," February 2014 and March 2015
  • Successfully defended global food and beverage company from class action asserting claims of unfair competition and false advertising under California law. Removed the case to federal court under the Class Action Fairness Act and drafted motion to dismiss. Plaintiff voluntarily dismissed the case.
  • Successfully defended international luxury specialty department store from class action asserting claims of unfair competition and false advertising arising from retail pricing policies. Removed the case to federal court under the Class Action Fairness Act and drafted motion to dismiss, which the court granted without leave to amend.
  • Currently defending global food and beverage company against breach of contract, tort, and unfair competition law claims arising from a commercial dispute with a former supplier.
  • Currently representing outdoor recreation merchandise retailer in consumer class action brought under California’s Invasion of Privacy Act challenging company’s call recording/monitoring practices.
  • Currently representing general contractor and surety in post-trial and appellate proceedings in suit alleging breach of contract and statutory prompt payment penalty claims by subcontractor on public works project.
  • Currently representing national retailer of kitchenware products in trade dress dispute.
  • Represented national appraisal service in defending against government claims arising from appraisals performed for now insolvent savings and loan association.
  • Represented pharmaceutical company in class action litigation as well as matters asserting strict product liability claims.
  • Currently representing national energy company and its subsidiary in consumer class actions brought under the Telephone Consumer Protection Act ("TCPA") and pre-litigation matters alleging violations of the TCPA.
