Brian Kluckman is an associate in the Commercial Disputes practice group of the firm’s Pittsburgh office. Mr. Kluckman has over seven years of complex commercial and criminal litigation experience in federal, state, and military courts.

Mr. Kluckman has experience handling all phases of litigation from helping clients draft a response to an initial demand letter through successfully representing clients as lead counsel in contested jury and bench trials, as well as numerous administrative hearings.

Professional Background

In 2016, Mr. Kluckman rejoined the firm after a successful stint as a United States Marine Corps judge advocate.

Mr. Kluckman served as a Marine judge advocate from 2012-2016. Primarily, Mr. Kluckman worked as a criminal defense counsel who represented service members charged with felony and misdemeanor-level crimes under the UCMJ. As a defense counsel, he gained valuable courtroom and advocacy experience by presenting argument at numerous preliminary hearings, motions sessions, contested jury and bench trials, and sentencing cases. Mr. Kluckman won full acquittals in over 90% of his contested trials; each case had been investigated by federal law enforcement bodies. He was awarded the Navy and Marine Corps Commendation Medal for his representation of service members while a judge advocate.

Mr. Kluckman was a litigation associate with the firm from 2008 - 2012. During this time, he litigated commercial cases in a wide range of practice areas, including: insurance coverage, antitrust, U.C.C. and contract dispute, unfair trade practices act, real estate assessment appeal, product liability, business interference tort, mass tort, and wrongful death action matters. For example, Mr. Kluckman played an integral role in winning a $3 million New Jersey state court jury verdict in a trade libel case on behalf of a Commodity Trading Advisor (CTA) client. Also, he was co-counsel on a Pennsylvania trial which challenged the assessed property values of a national retailer’s mall anchor-store properties, which resulted in a negotiated settlement saving the client over $1 million in tax liability.

Mr. Kluckman was a summer associate at the firm in 2007.

While in law school, Mr. Kluckman completed a judicial externship with the Honorable David S. Cercone, District Judge, U.S. District Court, Western District of Pennsylvania
