Brian Phillips is counsel in the firm’s Raleigh office, where he advises clients on the protection and monetization of intellectual property through the licensing, research and development, divestiture, and commercialization of products and technologies. He represents clients from startups to academic institutions to global corporations across a broad range of industries including life sciences, software and technology, health care, consumer packaged goods, financial services and music, media, and entertainment.

Mr. Phillips’s transactional practice focuses on drafting and negotiating licensing, technology transfer, Software as a Service (SaaS), product supply/distribution, research and development, material transfer, professional services, publishing, and nondisclosure/confidentiality agreements. He also conducts intellectual property due diligence in connection with M&A transactions. Mr. Phillips routinely counsels clients on other aspects of intellectual property, including portfolio management, patent, trademark, and copyright search and clearance, and product labeling and advertising and marketing claims review.

In addition to intellectual property matters, Mr. Phillips also advises on regulatory compliance with both Environmental Protection Agency (“EPA”) and Food and Drug Administration (“FDA”) regulations and guidelines. He has particular experience with the EPA’s regulation of pesticides under the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”) as well as the FDA’s regulation of complementary and alternative medicines, including OTC homeopathic products.

Mr. Phillips is a registered patent attorney with a technical background in molecular biology and chemistry. Prior to law school, he researched rare kidney and autoimmune diseases at the University of North Carolina at Chapel Hill.
