The so-called "small amendment" or “Public Procurement Law” introduced an exception to the principle of equal treatment of operators. According to the new wording of the PPA, it is acceptable to the unequal treatment of contractors, supplies, services, or construction works from countries outside the EU, the States Parties GPA, or other international agreements, which the EU is a party. This possibility is not unrestricted. The contracting authorities should therefore pay special attention to the use of mechanisms such permissible discrimination contractors, supplies, services, or construction works that do not violate other rules under the Public Procurement Law, which did not experience an exception.
