In early 2022, the DOJ announced that it was focused on addressing director interlocks that violate Section 8 of the Clayton Act. Since then, DOJ has announced actions to address several violations, and the FTC has also pursued similar concerns under Section 5. This panel will explore where the agencies are headed now and how companies can adopt compliance policies to address these concerns.
